eCard Terms and Conditions

  1. General Terms
    Facebook eCards are distributed by CashStar, Inc., a Delaware corporation ("CashStar"). You agree that the laws of the State of Maine, without regard to principles of conflict of laws, will govern these Gift Card terms and conditions ("Ts & Cs"). CashStar reserves the right to change these Ts & Cs from time to time in its discretion. Facebook eCards are issued by Facebook Payments Inc., A Florida corporation. Please refer to www.facebook.com/payments_terms for additional Terms and Conditions.
  2. Redemption
    Refer to www.facebook.com/payments_terms for Terms and Conditions of redemption. To redeem an eGift Card visit www.facebook.com/giftcards/redeem, follow the instruction and when prompted, enter the eCard code.
  3. View Your Balance
    To view your eCard balance, follow the instructions below your eCard, on the page linked from the email message which notified you of your gift.
  4. Returns
    You may not return or cancel your Facebook eCard.
  5. Lost or Stolen Gift Cards
    If you suspect that someone has copied or stolen your eCard, contact Customer Support immediately. eCards will not be replaced if lost or stolen without the purchaser's confirmation email as proof of purchase. eCards have cash value and should be safeguarded accordingly.
  6. Limitations
    You may not use an eCard to purchase other eCards.
    This eCard may be redeemed on Facebook only by persons age 13 and older. To redeem this card, visit www.facebook.com/giftcards/redeem. Internet access is required (separate fees may apply). The full value of this eCard is deducted at PIN entry. No incremental deductions are allowed. This eCard is not redeemable for cash and cannot be returned for a cash refund, exchanged, or resold (except where required by law). The date of issuance of this eCard is the date of purchase. No refunds or credits will be provided for lost, stolen, or destroyed cards, or for eCards used without permission. Use of this eCard is governed by the Facebook Payments Terms, which are available at www.facebook.com/payments_terms and subject to change from time to time without notice to the extent permitted by law. Protect this eCard like cash. This card is issued by Facebook Payments Inc., a Florida corporation. Unused eCards may not be transferred.
  7. Our Policies
    eCards are subject to CashStar's Privacy Policy. CashStar and Facebook, Inc. may provide eCard purchasers with information about the redemption status of eCards.
  8. Risk of Loss
    Ownership and risk of loss of eCards passes to the purchaser as soon as we send our confirmation to the recipient. We are not responsible for lost or stolen eCards.
  9. Facebook eCard Customer Service
    If you need assistance with any aspect of your purchase, ownership, or use of your eCard, please contact Customer Support. Please refer to your order number, or be ready to supply your email address.
  10. Delivery Information and Requirements for eCard Purchasers
    All orders of eCards are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser's financial institution. If there is a discrepancy, your eCard order may be delayed until it can be corrected.
    If the date on which you want an eCard delivered has passed and you have not received confirmation that the eCard was sent, please contact Customer Support. Please refer to your order number, or be ready to supply your email address.
    We are not responsible for eCards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address of the recipient is correct and contact Customer Support if you suspect the recipient did not receive his/her eCard. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.
  11. Reasons for Failed Delivery
    If you have confirmed the recipient's email address but the eCard has not been viewed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:
    1. Spam filter blocked email or routed it to a bulk/spam folder
    2. Recipient's firewall blocked the email
    3. Email inbox is over size limit
    4. Invalid email address
    If a spam filter is blocking giftcards@cashstar.com emails from getting to an inbox, the email options will need to be modified so that giftcards@cashstar.com emails are not considered spam.

  12. Limitation of Liability
    CASHSTAR AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ECARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF AN ECARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
  13. Disputes
    You hereby consent that any dispute relating in any way to Facebook eCards shall be adjudicated in Cumberland County, Maine if the aggregate total claim for relief exceeds $7,500, and you consent to exclusive jurisdiction and venue in such courts.
